Terms of Service

Please read these Terms of Service carefully before using OurWeek. By downloading, installing, or using the app, you agree to be bound by these terms. If you do not agree, do not use the app.

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and OurWeek ("we," "us," or "our") governing your access to and use of the OurWeek mobile application (the "App") and any related services.

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Description of Service

OurWeek is a mobile application designed to help families create and manage communal events. The App allows users to coordinate schedules, share activities, and keep everyone in sync with shared calendars. The App may offer both free and premium features. Premium features are available through a paid subscription as described below.

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice, without liability to you.

Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

Accounts & Security

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties.

Subscriptions & Billing

OurWeek offers auto-renewable subscription plans that unlock premium features. By purchasing a subscription, you agree to the following terms:

Payment: Payment will be charged to your Apple ID account at confirmation of purchase. All payments are processed through the Apple App Store. OurWeek does not directly collect or store your payment information.

Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of your chosen subscription plan.

Manage Subscriptions: You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings on your device after purchase.

Price Changes: Subscription prices may change from time to time. You will be notified in advance of any price increase, and your consent will be required if applicable under App Store policies.

Subscription options and pricing are displayed within the App at the time of purchase. Prices are in the currency of your App Store region and may vary by location.

Free Trials

OurWeek may offer a free trial period for certain subscription plans. If you begin a free trial, you will not be charged during the trial period. However, if you do not cancel at least 24 hours before the free trial ends, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged.

Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same plan. Free trial eligibility is determined by the App Store and may be limited to one trial per Apple ID.

Cancellation & Refunds

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of the current billing period — you will retain access to premium features until that date. No partial refunds are provided for the current billing period upon cancellation.

Since all purchases are processed through the Apple App Store, refund requests must be directed to Apple. You can request a refund by visiting reportaproblem.apple.com or contacting Apple Support. OurWeek does not have the ability to issue refunds for App Store purchases.

You may restore previously purchased subscriptions at any time by using the "Restore Purchases" option available within the App.

We reserve the right to take any action we deem necessary if you violate these terms, including termination of your account and access to the App.

Intellectual Property

The App, including all content, features, functionality, design, text, graphics, logos, icons, and software, is the exclusive property of OurWeek and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any of its contents without our prior written consent.

Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Any information or recommendations provided by the App are for informational purposes only. You are solely responsible for any decisions you make based on information obtained through the App.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OURWEEK, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, provide additional notice within the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

Indemnification

You agree to indemnify, defend, and hold harmless OurWeek, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable laws or regulations.

Dispute Resolution & Arbitration

Most concerns can be resolved quickly by contacting us at dealsafeapp@gmail.com. If we cannot resolve a dispute informally, you and OurWeek agree to resolve any claims through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration Agreement: Any dispute arising from or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the English language and take place in the United States.

Class Action Waiver: You and OurWeek agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Jury Trial Waiver: You and OurWeek waive any right to a jury trial.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to dealsafeapp@gmail.com within 30 days of first using the App. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

Governing Law

These Terms and any disputes arising out of or related to these Terms or the App shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.
